Terms of Service

FreeUpscaler is a client-side web application. It runs AI models inside your web browser and processes your files on your device. We do not host, receive, or store the files you process. See our Privacy Policy for the full details on what data is and is not collected.

The Service is provided free of charge. We may change, suspend, or discontinue any part of the Service at any time, including adding or removing features, adjusting performance, or changing supported browsers. We'll aim to communicate material changes on the site when we can.

You retain all rights to the files you upscale using the Service and to the upscaled outputs they produce. Because your files are processed on your device and never sent to us, we make no claim to them and receive no copy of them. The outputs are yours to use however you wish, subject to any rights that third parties may hold in the original source material.

The Service itself — the website code, design, text content, and the FreeUpscaler and Stackviv names and logos — is owned by Stackviv or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, or redistribute the Service except as permitted under open-source licenses for the components that are distributed that way.

You agree not to use the Service to:

• process content that you do not have the legal right to use, including content that infringes third-party copyrights, trademarks, or privacy rights;
• create or distribute non-consensual intimate imagery, content depicting the sexual exploitation of minors, or any content that is illegal where you are or where the recipient is;
• generate synthetic media intended to deceive (for example, deepfakes of real people without consent for impersonation, fraud, harassment, or defamation);
• attempt to reverse engineer, scrape at scale, overload, or interfere with the normal operation of the Service or its infrastructure;
• circumvent, disable, or tamper with any security, access control, or advertising mechanism on the site.

You are solely responsible for what you process with the Service and for how you use the outputs.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY PARTICULAR QUALITY OF OUTPUT.

AI upscaling is probabilistic and dependent on the content of your input. Output quality varies. The Service is not intended for forensic, medical, legal, safety-critical, or similar uses where exact reconstruction of detail matters.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACKVIV AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

The Service uses third-party infrastructure to deliver the website (for example, Cloudflare for hosting and Google AdSense for advertising) and may link to external sites. We are not responsible for the content, policies, or practices of those third parties. Use of their services is governed by their own terms.

We may update these Terms from time to time. When we make material changes, we'll update the effective date at the top of this page. Continued use of the Service after the effective date means you accept the revised Terms.
